With the onset of ride sharing business such as Uber and Lyft, it’s inevitable that accidents will occur. With the help of one of our personal injury lawyers at Brown Law, you can understand all the steps to take after you’ve been involved in an accident with an Uber or Lyft driver.
As in any other car accident, the person that is bringing forth a personal injury claim must prove that there is liability and resultant damages. If you were hit by an Uber or Lyft driver, you must prove that someone was negligent in order to have a viable claim. The trick with these types of accidents is determining whether you go after the driver’s insurance or the rideshare companies.
Car Insurance and Ridesharing Companies
These ridesharing companies do require that these drivers have personal car insurances that meets the minimums for liability coverage (and the company provides liability coverage too). If the driver was logged into their app and is on their way to a ride or is in route, Uber or Lyft provides liability coverage up to $1 million. However, if the driver was logged in, but hadn’t accepted a ride, Uber or Lyft will provide liability coverage that is the fault of the driver (up to $50,000 per person injured in an accident and $100,000 total injury liability) as well as up to $25,000 in property damages.
What to Do After Being in an Accident
The first thing you should do after any accident is to get the names and contact information of all those involved. Next, call the police to file a police report so that the accident can be investigated immediately. This report will serve as evidence to the auto insurance company and will help to prove both liability and negligence.
