Ms. Cassett secured a verdict of $1.2 million in the case, which wound up being the sixth-highest verdict for 2017 in the motor vehicle accident category in the state of New Jersey. Her verdict amount was also tied for 20th highest verdict in the state when compared to all legal categories and has the date of January 19, 2017 attached to it. The trial lasted just four days and the jury verdict was unanimous.
The Accident That Led to the Lawsuit
The accident that led to the lawsuit occurred on August 27, 2008 on Delilah Road in Egg Harbor Township, Atlantic County. The plaintiff, Michele Davis, was a rear passenger in a Nissan Altima that was stopped while waiting its turn to enter into an intersection. While stopped, the Altima was hit from behind by a vehicle that was being driven by Ginnie Dawson. The impact was so strong that it caused the Altima to hit a vehicle that was in front of it.
Injuries Suffered in the Crash
An ambulance transported Davis to AtlantiCare Regional Medical Center. She was evaluated and released on the same day. Davis wound up being diagnosed with injuries to discs C3-4 and C4-5. One injury was a disc bulge and the other was a herniated disc. Additional evaluation discovered that Davis suffered radiculopathy that went from the C5 vertebrae into the upper area of her body. An original complaint from the crash by Davis was centered around back pain. It wasn’t until a couple of years after the crash that Davis was diagnosed with a herniation of disc C5-6. Davis underwent therapy, including multiple epidural injections to the cervical spine.
Since the accident, Davis has complained of chronic neck pain and had not undergone any surgeries to reduce the pain. Davis claimed that the chronic pain caused her trouble when caring for her elderly grandmother.
Underinsured Motorist Claim
The defendant in the accident case offered to provide Davis with her entire insurance policy, which was for $15,000. Davis then decided to file an underinsured motorist claim against the defendant and the defendant’s insurance company, Allstate.
